Legalization and Apostille of digital documents

In accordance with Decree 172/2019, an important modification was introduced in the regime of public documents´ Apostille. Effective from March 1, 2019, the Apostille, which is the mean of legalization of documents to have international validity, must be digitally managed to legalize public documents created or reproduced electronically, digitalized and considered original.

These changes take place within the framework of the ‘State Modernization Plan’ promoted through Decree 434/16, with the aim of reduce use of paper within the Public Administration, they mean a vindication of the institutes of the electronic document and the digital signature. “The problem of fraud is virtually eliminated with the electronic system (…)”, said Alejandro Hasperué, legal advisor in the International Legal Support Department of the Ministry of Foreign Affairs and Worship, in an exhibition of the project carried out in the Faculty of Law of the Buenos Airs University.

Although it is pending regulation by the Administrative Modernization Secretariat, we foresee that it will be implemented through the platform of “Remote Procedures” (TAD) of the Electronic Document Management System – GDE.

On the other hand, as for the traditional Apostilles, paper documentation, from now on, people who require legalizing Argentine public documents to be presented abroad must request shifts through the Internet.
